LUCKNOW: The Lucknow bench of the Allahabad High Court on Wednesday
asked Basic Education Officer (BEO) to inspect City Montessori School's
Indiranagar branch premises on Thursday and ascertain if there is
enough space to accommodate 31 children from economically weak section,
short-listed by the district administration under the Right to Education
Act for admission in the said school.
The court has also directed the BEO to ascertain whether classes for Montessori, nursery and KG are being conducted in the second shift or not and whether it is possible to conduct the second shift without unnecessary financial and other burden on the school. The BEO should file his report based on the inspection on July 17.
The order came on petition filed by the CMS challenging April 6 order of BEO to admit 31 students of economically weaker sections at its Indiranagar branch. Admissions were to be taken as per the clause of the RTE Act which calls for a 25% reservation in private schools for children from disadvantaged groups and economically-weaker sections of society.
When contacted, CMS founder-manager Jagdish Gandhi said, "We are happy with the court's directives and want a government official to inspect our school. We can't admit 31 students as there are no vacancies in any sections, in nursery or class I, in both shifts,'' he told TOI.
Meanwhile, Magsaysay awardee Sandeep Pandey, who has been demanding admissions of these 31 underprivileged children in CMS, Indiranagar, continued hunger strike for sixth day.
